Privacy Policy

1. Overview

Ravenwood Tech LLC ("we," "us," "our") operates Budulai, a privacy-first AI assistant for iPhone. This policy explains what we access, what we retain and for how long, who we share it with, and your rights.

Our principles: your conversation history lives primarily on your device; we keep only the minimal server-side data needed to operate the Software safely and reliably; we retain that data for a short, defined period; we do not sell your personal information; and we do not use your conversations to train AI models. We are honest that some data is retained — Budulai is privacy-first, not "zero-retention."

2. How AI Inference Works

When you send a message, your message plus the context needed to answer it (recent messages, and the profile/context you've provided) is sent over encrypted HTTPS/TLS to our private AI inference proxy (api.budulai.net), authenticated with HMAC-SHA256 session tokens over certificate-pinned connections. The proxy forwards it to a large language model running on hardware Ravenwood operates, and the response is streamed back to your device.

The language model is Qwen, developed by Alibaba Cloud and used under the Apache License 2.0. Importantly, we run it on our own infrastructure — your messages are processed by our private deployment and are NOT sent to Alibaba or to any public AI service.

3. What We Retain, and For How Long

To keep Budulai safe, lawful, reliable, and abuse-free, our proxy retains a limited amount of operational data:

(a) Message excerpts & request metadata — a short excerpt/preview of requests plus metadata (timestamp, model, message count, token counts, latency, status, and the network IP used for rate-limiting and abuse-prevention). Used for safety, abuse-prevention, debugging, and reliability. Retained for up to thirty (30) days, then deleted.

(b) Safety review — content flagged by automated safety systems or reported by users may be reviewed and retained longer where necessary to investigate abuse, comply with law, or enforce our Terms.

(c) Account information — your name and email (via Firebase Authentication) and your subscription status, retained while your account is active and deleted within thirty (30) days of account deletion.

(d) Proactive-notification scheduling — if you enable proactive features, limited scheduling data (notification text, send time) is stored on our notification server and purged within seven (7) days of delivery or cancellation. Separately, a personalization context and a last-activity timestamp are kept for as long as proactive notifications remain enabled on your account, so that we can generate relevant messages; these are deleted when you delete your account. You can disable proactive notifications in Settings. Proactive notification text is generated by a smaller Qwen model running on the same Ravenwood-operated hardware.

(e) Crash & performance diagnostics — via Firebase Crashlytics (device type, OS/app version, stack traces). Not linked to your conversation content.

(f) Product analytics — via Firebase Analytics. We log a small set of product events (sign-in, onboarding completion, first message sent, subscription selection and restore, and account deletion), together with the standard events the Firebase SDK collects automatically (such as app open and session start). These record that an action happened, not what you said. We do not use analytics for advertising or cross-app tracking.

We do NOT sell your personal information, and we do NOT use your conversations to train, fine-tune, or improve AI models.

4. Data Processed On Your Device (Not Stored on Our Servers)

The following is read and used on-device and is included as context with AI requests only when relevant; raw data is not stored on our servers (excerpts may appear in the limited 30-day operational data described in Section 3):

(a) Conversation history and file attachments — stored on your iPhone, encrypted via iOS Data Protection.

(b) Health & fitness data (HealthKit) — we request only step count and walking/running distance. These are summarized on-device (e.g. "Today's steps: 6,200") before being used as context; the underlying samples are never sent. If you connect a Bluetooth health device, readings from it (such as heart rate, blood pressure, or weight) are included as context with your AI messages so Budulai can respond to them. Health data is not stored on our servers, though a short excerpt of your own message may appear in the operational data described in Section 3.

(c) Calendar and reminders (EventKit) — read on-device. Before event titles, event locations, and reminder titles are used as AI context, they pass through a best-effort keyword filter that generalizes common medical, legal, financial, and personal-care terms (for example, an appointment title matching "oncology" becomes "Medical appointment" and its venue is omitted). This filter matches English keywords only and is not a guarantee that every sensitive detail is caught. Event notes and attendee lists are never used as context.

(d) Location (CoreLocation) — with your permission, your approximate location is used as context. Coordinates are rounded to roughly 100 metres before being included with an AI message. Where available, a reverse-geocoded neighbourhood or a place you have saved (e.g. "Home") may be included instead. Precise coordinates are used only on-device, and only to draw a map you have asked for.

(e) Motion/activity — current activity state, used as context.

(f) Contacts — only those you choose to share are used as context.

(g) Memory — as you chat, Budulai keeps short notes about you (for example who the people in your life are, your projects, and how you like Budulai to help) so later chats can pick up where you left off. Notes are stored on your iPhone with iOS Data Protection. Notes relevant to a message are included as context with that message, like the rest of this section. Budulai does not save health conditions or treatment, sexual matters, ID, account or card numbers, passwords or codes, criminal history, or immigration status. You can see and delete any note, delete all of them, or turn learning off in Settings → Memory.

(h) Conversation summaries — when a conversation grows long, Budulai automatically summarizes its older part so it can keep up. The summary is stored on your iPhone with that conversation; the full conversation stays on your iPhone too.

5. Autonomous Actions

When you direct Budulai to send email or control a connected Mac (Techlepathy), the data needed to perform that action is processed to carry it out. The remote-control feature may retain limited operational logs (e.g., action records) under the retention limits in Section 3. You are responsible for the actions you direct (see Terms, Section 4).

6. Third-Party Services

Each has its own privacy policy:

(a) Firebase Authentication / Crashlytics (Google) — sign-in and crash reporting. https://policies.google.com/privacy

(b) Google Gmail API — if you connect Gmail, OAuth is used to access your mail to perform the actions you request.

(c) ElevenLabs — text-to-speech (an outside AI voice service). Only when you play a reply out loud or use voice chat, and only after you allow it in the app, the text of that reply is sent to ElevenLabs to turn it into speech. Your name, email, profile, and the rest of your conversation are not sent. https://elevenlabs.io/privacy-policy

(d) Tavily — web search; queries are sent to return results.

(e) Alibaba Cloud (Qwen API) — used in two clearly bounded places, both of which you choose:

(i) Deep Research. When you explicitly run a Deep Research task (a Pro feature you initiate per-use), and only after you allow it in the app, your research topic and related web content are sent to Alibaba Cloud's Qwen API for analysis and synthesis. Search queries made from your topic are sent to Tavily to find sources.

(ii) Remote Mac control, only if you turn it on. Remote Mac control ("Techlepathy") runs on Ravenwood-operated hardware by default. In Settings you may opt in to running it on Alibaba Cloud's advanced Qwen model instead, which handles long multi-step tasks better. This is off unless you enable it, we show you exactly what is shared before you agree, and you can switch back at any time. When it is on, these are sent for that feature only: the instruction you give Budulai for your Mac, the commands it plans and their output, screenshots and on-screen text when it needs to see your screen, and the names and contents of files it reads to carry out your task. We do not send your name, email, or account identifier with these requests.

In neither case do we send your chat conversations, personal profile, health data, calendar, reminders, location, or Gmail. Everyday chat always runs entirely on Ravenwood-controlled hardware. (f) Apple HealthKit, EventKit, CoreLocation, CoreBluetooth — on-device frameworks.

Payments are processed by Apple via StoreKit; we never see your payment details.

Asking first. Before Budulai sends anything to an outside AI service (ElevenLabs for voice, Alibaba Cloud for Deep Research or the optional Mac-control engine), the app tells you what will be sent and who receives it, and asks for your permission. You can withdraw it at any time in Settings → Connections → Outside AI Services (and, for Mac control, in its engine setting). Everyday chat never uses an outside AI service.

Equal protection. We share data with these providers only to deliver the feature you asked for, and we use them only on terms under which they protect that data at least as well as this policy does: they process it only to provide their service to us, keep it confidential and secure, and do not sell it.

7. Data Retention Summary

(a) Operational data / message excerpts: up to 30 days. This is enforced automatically by a scheduled job on our server that deletes expired records every hour.

(b) Flagged/reported safety content: as long as needed for investigation, legal compliance, or enforcement.

(c) Account info: while active; deleted within 30 days of account deletion.

(d) Notification scheduling records: purged within 7 days of delivery/cancellation. Proactive personalization context: kept while proactive notifications are enabled, deleted on account deletion.

(e) Crash/diagnostics and product analytics: per Google's retention (typically up to 90 days for diagnostics; analytics event data up to 14 months).

(f) On-device data: until you delete it or uninstall the app.

(g) Memory notes and conversation summaries: on your iPhone until you delete them (Settings → Memory, or by deleting the conversation) or delete your account.

8. Your Rights

Subject to your location, you may have rights to access, correct, delete, port, restrict, or object to processing of your personal data, and to opt out of non-essential communications. To exercise them, contact john@budulai.app; we respond within thirty (30) days. You can delete your account in-app (Settings → Delete Account, or Settings → Profile → Delete account), which deletes your account and the associated server-side data described in Section 3.

9. California Privacy Rights (CCPA/CPRA)

California residents have the right to know, delete, correct, and opt out of "sale"/"sharing." We do not sell your personal information and do not share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. In the prior 12 months we have collected: account information, limited message excerpts/metadata, and diagnostics, as described above. Contact john@budulai.app.

10. European/UK Privacy Rights (GDPR/UK GDPR)

If you are in the EEA, UK, or Switzerland: our legal bases are your consent (account creation, optional permissions), contractual necessity (providing the Service), and legitimate interests (safety, abuse-prevention, security, diagnostics). Data may be processed in the United States under appropriate safeguards (e.g., Standard Contractual Clauses). If you run a Deep Research task, that request is processed by Alibaba Cloud's Qwen API on infrastructure located in Singapore. You may lodge a complaint with your local supervisory authority. 11. Security

(a) HTTPS with a TLS 1.2 minimum, and certificate-authority pinning on connections to our inference proxy (api.budulai.net). Connections to third-party services such as Google use standard system certificate validation. (b) Session tokens are HMAC-SHA256 signed and verified with a constant-time comparison. (c) Authentication tokens, credentials, and profile fields are stored in the iOS Keychain. (d) Conversation history, attachments, and action records are written with iOS Data Protection (Complete File Protection); other app files use the iOS default protection class. (e) We block link previews from resolving to private, loopback, or link-local network addresses. No system is perfectly secure; we cannot guarantee absolute security, and we minimize what we retain to reduce risk.

12. Children's Privacy

Budulai is intended for users 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn we have, we will delete it. Contact john@budulai.app.

13. Changes to This Policy

We may update this policy and will notify you of material changes by email or in-app notice at least thirty (30) days before they take effect. The Effective Date above shows the latest revision.

Terms of Service

Effective Date: August 8, 2026

1. Acceptance of Terms

By downloading, installing, or using Budulai ("the Software"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Software. These Terms are a legally binding agreement between you and Ravenwood Tech LLC, an Oregon limited liability company ("Company," "we," "us," or "our").

You must be at least eighteen (18) years old to use Budulai. By using the Software you represent that you are 18 or older and have the legal capacity to enter into these Terms.

We may update these Terms from time to time. We will notify registered users of material changes by email or prominent in-app notice at least thirty (30) days before they take effect. Continued use after changes take effect constitutes acceptance.

2. Description of Service

Budulai is a privacy-first AI assistant for iPhone. It provides:

(a) AI Chat — conversational AI. Your messages and the context needed to answer them are sent over encrypted (HTTPS/TLS) connections to Ravenwood Tech's private AI inference proxy, processed by a large language model running on Ravenwood-operated hardware, and streamed back to your device. We retain a limited amount of operational data for a short period for safety, abuse-prevention, reliability, and support purposes — see the Privacy Policy for exactly what and for how long. We do not sell your data and we do not use your conversations to train AI models.

(b) Device Automation — on-device actions such as opening apps, composing texts and emails, setting timers, controlling brightness and flashlight, navigating via Apple Maps, haptics, clipboard, sharing, App Store search, and deep links. These execute locally on your iPhone.

(c) Calendar & Reminders — creating, editing, and querying calendar events and reminders via Apple EventKit. This data stays in your iCloud/local calendar.

(d) Health & Fitness — reading step and walking/running distance data via Apple HealthKit, and connecting to Bluetooth Low Energy (BLE) health devices via CoreBluetooth. HealthKit data is summarized on your device before use. Readings from a connected BLE device may be included as context with your AI messages. Health data is not stored on our servers. See the Privacy Policy, Section 4(b).

(e) Proactive Notifications — optional smart notifications (calendar events, check-ins, special-date reminders). Scheduling data is handled by a background engine; see the Privacy Policy.

(f) Remote Mac Control ("Techlepathy") — on supported tiers, after you install and authorize the companion agent on a Mac you own or control, Budulai can perform actions on that Mac (e.g., open apps, manage files, run system commands you direct). You are solely responsible for the Mac, the actions you direct, and any consequences. See Section 4.

(g) Third-Party Integrations — optional connections such as Gmail (via Google OAuth 2.0). These communicate between your device (or our proxy, where applicable) and the third-party service under that service's terms.

(h) Web Search — optional web search via Tavily. Queries are sent to Tavily's API to return results.

(i) Text-to-Speech — optional read-aloud via ElevenLabs. Response text is sent to ElevenLabs for audio synthesis.

(j) Location Awareness — with your permission, approximate location context (coordinates rounded to roughly 100 metres, or a neighbourhood or saved place name) may be included with AI messages to enable location-relevant responses. See the Privacy Policy, Section 4(d).

3. Data Handling, Safety & Monitoring

Budulai is privacy-first, but it is not "zero-retention." To keep the Software safe, lawful, reliable, and abuse-free, we retain a limited amount of operational data for a short, defined period and we may review content that is flagged by automated safety systems or reported by users. The specifics — what we retain, why, for how long (currently up to 30 days for safety/diagnostic data), who can access it, and your rights — are set out in the Privacy Policy, which is incorporated into these Terms.

We do not sell your personal information, and we do not use your conversations to train, fine-tune, or improve AI models. Your conversation history is stored primarily on your device; you can delete it at any time.

4. AI Limitations, Autonomous Actions & Your Responsibility

(a) AI output may be wrong. Budulai is an AI system. Its responses can be inaccurate, incomplete, outdated, or fabricated ("hallucinated"). You are responsible for independently verifying anything important before relying on it.

(b) Not professional advice. Budulai does not provide medical, legal, financial, tax, mental-health, or other professional advice, and is not a substitute for a qualified professional. Do not make medical, legal, financial, or other significant decisions based on Budulai's output without consulting a licensed professional.

(c) Not for emergencies. Budulai is not an emergency service and cannot reliably contact emergency responders. In an emergency, call your local emergency number (e.g., 911) directly.

(d) Actions you direct are your responsibility. When you instruct Budulai to take an action in the real world — send an email, control a connected Mac, create or modify calendar/reminder entries, open the dialer to a phone number, or interact with a third-party service — you authorize that action and are solely responsible for it and its consequences, including ensuring it is lawful and appropriate. We are not responsible for actions you direct Budulai to perform. We recommend reviewing drafted content (such as emails and messages) before it is sent or executed.

5. Acceptable Use

You agree not to use Budulai to:

(a) Violate any applicable law or regulation, or facilitate illegal activity.

(b) Generate, solicit, store, or distribute content that sexually exploits or endangers minors (CSAM), incites or threatens violence, harasses, defames, or unlawfully discriminates against others.

(c) Create malware, weapons, or instructions for serious physical, biological, chemical, or cyber harm.

(d) Use the email, remote-control, or other action features to harass, defraud, deceive, impersonate, surveil, or harm others, to contact anyone who has not consented where consent is required, or to send unsolicited bulk or automated communications.

(e) Attempt to reverse-engineer, decompile, or extract source code or proprietary components, or circumvent subscription, rate-limiting, safety, or license-enforcement mechanisms.

(f) Resell, sublicense, rent, or transfer your access without our written consent, or use the Software to build a competing product or for benchmarking.

(g) Overburden, disrupt, or gain unauthorized access to our or any connected systems.

We may suspend or terminate access, and may remove or refuse content or actions, that violate this Section or that our safety systems flag as abusive or unlawful.

6. Reporting & Content Concerns

You can report objectionable AI output or misuse from within the app or by contacting john@budulai.app. We review reports and may act on them, including removing content, restricting features, or terminating accounts.

7. Subscriptions and Payment

Certain features require a paid subscription processed through the Apple App Store. By subscribing, you authorize Apple to charge your payment method on a recurring basis at the then-current rate.

(a) Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.

(b) Manage or cancel anytime in Settings → Apple ID → Subscriptions.

(c) Refunds are handled by Apple under their policies.

(d) We may change pricing with thirty (30) days' notice to active subscribers; changes do not affect the current period.

(e) Free-tier features are provided as-is, with no guarantee of continued availability.

8. Intellectual Property

Budulai and its software, documentation, branding, and content are the property of Ravenwood Tech LLC, protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal or internal business purposes under these Terms and the EULA. The underlying language model is a third-party model used under its own license (see the EULA and Third-Party Software Notices). We make no ownership claim over AI outputs you generate, and make no representations about their accuracy, originality, or fitness for any purpose; how you use them is your responsibility.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RAVENWOOD TECH LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Software will be uninterrupted or error-free, that AI output will be accurate or appropriate, that integrations will function, or that health/fitness data will be accurate. You use all features and outputs at your own risk. AI-GENERATED CONTENT IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE, AND BUDULAI MUST NOT BE RELIED ON FOR EMERGENCIES, MEDICAL DIAGNOSES, OR CRITICAL DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAVENWOOD TECH LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE OR ANY ACTION TAKEN THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THIS APPLIES REGARDLESS OF THE THEORY OF LIABILITY. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ravenwood Tech LLC and its officers, members, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you generate or any action you initiate or direct through the Software.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Multnomah County, Oregon, and you consent to their exclusive personal jurisdiction. Before filing, you agree to first try to resolve the dispute informally by contacting john@budulai.app; if unresolved within thirty (30) days, either party may proceed.

13. Termination

We may suspend or terminate your access at any time, with or without cause or notice, including for violations of Section 5. On termination your license ends and you must stop using and delete the Software. Data on your device remains yours. Sections 4, 8, 9, 10, 11, 12, and 14 survive termination.

14. Severability; Entire Agreement

If any provision is held invalid, the rest remain in effect, and the invalid provision is modified to the minimum extent necessary to be enforceable. These Terms, with the Privacy Policy, EULA, and any subscription terms shown at purchase, are the entire agreement between you and Ravenwood Tech LLC regarding the Software.

End User License Agreement (EULA)

Effective Date: August 8, 2026

1. Agreement

This EULA is a legal agreement between you ("Licensee") and Ravenwood Tech LLC, an Oregon limited liability company ("Licensor"), for use of the Budulai application ("Software"). By installing or using the Software, you agree to this EULA. It supplements the Budulai Terms of Service and Privacy Policy, which are incorporated by reference.

2. License Grant

Subject to this EULA and payment of any applicable fees, Licensor grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Software on iOS devices you own or control, for your personal or internal business purposes.

3. License Restrictions

You may NOT: (a) copy, modify, or create derivative works of the Software; (b) reverse engineer, decompile, or attempt to derive source code or proprietary components; (c) sublicense, sell, rent, lease, transfer, or commercially exploit the Software; (d) remove proprietary notices; (e) use the Software to build a competing product or for benchmarking; (f) share your credentials or subscription; (g) circumvent subscription, rate-limiting, safety, or technical-protection measures; or (h) use the Software in violation of the Terms' Acceptable Use section.

4. Ownership

The Software is licensed, not sold. Ravenwood Tech LLC retains all right, title, and interest in the Software, including its branding, system prompts, skill-routing logic, and architecture. The underlying language model is a third-party model licensed separately (Section 6).

5. AI-Generated Content

AI output is provided for your use. Ravenwood Tech claims no ownership of AI output but makes no representations about its accuracy, originality, legality, or fitness for any purpose. You are solely responsible for reviewing and verifying AI output before relying on or distributing it.

6. Third-Party Components and Open-Source Licenses

(a) Qwen Language Model — Budulai's AI is powered by the Qwen family of large language models, developed by Alibaba Cloud and licensed under the Apache License, Version 2.0. Ravenwood Tech runs the model, unmodified, on its own infrastructure; it does not own the model weights or architecture and claims no ownership over them. Attribution: "This product uses the Qwen language model, Copyright Alibaba Cloud, licensed under the Apache License 2.0." A copy of the Apache License 2.0 is provided in the Third-Party Software Notices and at http://www.apache.org/licenses/LICENSE-2.0

(b) Firebase SDK (Google) — authentication, crash reporting, and product analytics. Apache License 2.0.

(c) Google Sign-In for iOS, and its AppAuth / GTMAppAuth / GTMSessionFetcher dependencies — Apache License 2.0.

(d) ElevenLabs — text-to-speech, under ElevenLabs' API terms.

(e) Tavily — web search, under Tavily's API terms.

A complete list of third-party components and licenses is available in the Third-Party Software Notices within the app.

7. Updates

Licensor may provide updates via the App Store, which may change functionality. This EULA applies to updates unless a separate agreement accompanies them. Licensor may modify, suspend, or discontinue the Software with reasonable notice to active subscribers.

8. Term and Termination

This EULA is effective on installation and continues until terminated. It terminates automatically if you breach it and fail to cure within fifteen (15) days of notice, if your subscription lapses (for subscription-gated features), if you uninstall, or if Licensor discontinues the Software. On termination you must stop using and delete all copies. Sections 3, 4, 5, 6, 9, 10, 11, and 12 survive termination. (Section 3's restrictions and Section 6's third-party attribution obligations survive because the open-source licenses that require attribution are perpetual; Section 12 survives because Apple's third-party-beneficiary rights do not lapse with the license.)

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR ACCURATE AI OUTPUT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF THIS EULA OR THE SOFTWARE. LICENSOR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). This cap is stated identically in Section 10 of the Terms of Service; the two are intended to be the same limit, not two different ones.

11. Governing Law; Severability; Entire Agreement

This EULA is governed by the laws of the State of Oregon, without regard to conflict-of-law principles; disputes are resolved exclusively in state or federal courts in Multnomah County, Oregon. If any provision is unenforceable, the rest remain in effect. This EULA, with the Terms of Service and Privacy Policy, is the entire agreement regarding the Software.

Order of precedence: if there is any conflict between this EULA, the Terms of Service, and the Privacy Policy, the Terms of Service control, except that the Privacy Policy controls on questions of what data we collect, use, retain, and share.

12. Apple App Store — Additional Terms

These terms apply because the Software is distributed through the Apple App Store, and are required by Apple:

(a) This EULA is concluded between you and Ravenwood Tech LLC only, and not with Apple. Ravenwood Tech LLC, not Apple, is solely responsible for the Software and its content.

(b) The license granted to you is a non-transferable license to use the Software on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

(c) Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Software.

(d) If the Software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Software. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Software.

(e) Ravenwood Tech LLC, not Apple, is responsible for addressing any claims relating to the Software or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

(f) In the event of any third-party claim that the Software or your possession and use of it infringes that third party's intellectual property rights, Ravenwood Tech LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.

(g) You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

(h) Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
